USPTO Adds Two Publications to Eight Sleep’s Portfolio
On October 13, 2022, the United States Patent and Trademark Office (USPTO) added two new patent assets to the portfolio of sleep technology company Eight Sleep. Eight Sleep is a sleep fitness company which markets the Pod, a thermoregulatory system for mattresses and mattress covers. On July 27, 2022, the company announced the release of the Pod 3 System. The Pod 3 technology features 5GHz compatibility, dual sensors which allegedly enable a 20% increase in HRV accuracy, and significantly increased sensor resolution for health tracking systems in comparison to previous Pod products. The thermoregulatory abilities and sensor systems of Eight Sleep’s Pods are described in US Patent No. 9,186,479 and US Patent No. 10,792,461, respectively. Eight Sleep is attempting to expand the protection of their Pod 3 system in the new publications, US Patent Pub. No. 2022/0322842, which describes the thermoregulatory abilities of the Pod, and US Patent Pub. No. 2022/0323713, which describes the new sensor technology and data analysis.
Since the company’s founding in 2014, Eight Sleep has amassed 7 patents in the Consumer Sleep Technology sector, but only one patent has been granted within the last two years. Additionally, four of the six parent applications of US Patent Pub. No. 2022/0323713 have been abandoned during the company’s attempts to expand protection for their sensor technology, meaning Eight Sleep still has an uphill battle ahead to expand protection for their newest data collection and analysis technology.
