FERC Order 841 Upheld by Appeals Court

A federal appeals court has upheld the Federal Energy Regulatory Commission’s Order 841, opening the door for distributed energy resources (DER) to participate in the energy market across the US. This ruling is a two-edged sword to the demand response industry. One the one hand, many of the same systems and methods used in demand response will also work in DER. On the other hand, there may be less need for demand response as this new capacity grows. The responsiveness of investment in DER will be a significant factor in determining the future growth of demand response.
